Welcome to Nsani Care, a healthcare platform designed to facilitate appointment scheduling, consultation services, and video calls with healthcare providers. By accessing or using Nsani Care, you agree to be bound by these Terms of Use. If you do not agree with these terms, please do not use the app.

1. Acceptance of Terms

By creating an account and accessing Nsani Care, you agree to these Terms of Use and acknowledge our Privacy Policy, which is incorporated into these terms by reference. Nsani Care reserves the right to modify these terms at any time. Your continued use of the app after any changes constitutes your acceptance of the revised terms.

2. Eligibility

To use Nsani Care, you must be at least 18 years old or have reached the age of majority in your jurisdiction. If you are under 18, you may only use Nsani Care with the consent and supervision of a parent or legal guardian who agrees to these Terms of Use on your behalf.

b. Prohibited Conduct

When using Nsani Care, you agree not to:

• Use the app for unlawful or fraudulent purposes.
• Impersonate any person or misrepresent your identity or affiliation.
• Interfere with or disrupt the app’s functionality or security.
• Attempt to access unauthorized areas or interfere with the app’s normal operation.
• Use automated scripts or software to access or use the app, except as allowed by Nsani Care.

Nsani Care reserves the right to suspend or terminate your account for violations of prohibited conduct.

5. Healthcare Services and Provider Responsibility

Nsani Care is a platform for facilitating communication and appointment scheduling with healthcare providers and is not responsible for the medical advice or treatment provided by these professionals. Healthcare providers are solely responsible for the quality and outcomes of their consultations, and Nsani Care does not employ or control them. Any reliance on the advice or information provided by healthcare providers is at your own risk.

6. No Emergency Services

Nsani Care is not intended for emergency or urgent care. If you have a medical emergency, please contact emergency services (e.g., 117) or go to the nearest emergency room. Nsani Care does not monitor urgent messages and is not liable for delays in response during critical situations.

7. Fees and Payment

Services within Nsani Care may require payment. By providing payment information, you agree to pay the associated fees for services as described at the time of purchase. Payment processing is handled by third-party providers, and Nsani Care does not store payment information. Fees are non-refundable unless otherwise stated or required by law.

8. Privacy and Data Security

Your privacy is important to us. Nsani Care collects and processes personal information in accordance with our Privacy Policy. By using the app, you consent to our collection, use, and sharing of your data as described in our Privacy Policy. While we take reasonable measures to protect your data, no security measures are infallible, and we cannot guarantee absolute security.

9. Limitation of Liability

To the maximum extent permitted by law, Nsani Care and its affiliates, officers, employees, and agents are not liable for any indirect, incidental, special, or consequential damages arising out of or related to your use or inability to use the app, including but not limited to damages for loss of data, personal injury, or other intangible losses.

Nsani Care does not guarantee that the app will always be available, uninterrupted, secure, or error-free, and is not liable for any technical or operational issues that may affect your experience.

10. Indemnification

You agree to indemnify, defend, and hold harmless Nsani Care, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the app, your violation of these Terms of Use, or your infringement of any rights of a third party.

11. Intellectual Property

All content, trademarks, logos, and intellectual property in Nsani Care are owned by Nsani Care or licensed by third parties and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the app without our express permission.

12. Termination of Use

Nsani Care reserves the right to suspend or terminate your account at any time, with or without cause, and with or without notice, if you violate these Terms of Use, engage in conduct that harms other users or healthcare providers, or for other reasons at our discretion. Termination will not limit any of Nsani Care’s other rights or remedies.

13. Governing Law and Dispute Resolution
